A prison system does not have to be uncivilised to be other than soft. Look at the prison system in Norway. Low re-offending rates from what we might call serious criminals all because the system teaches personal responsibility and teaching that risks/reward for actions should be measured over years or even a lifetime, not weeks, days or hours.

In any fully socialist society there are massive deterrents to any form of subversion to the state. You get sent to a gulag along with your family, run over by a tank on TV or sent to a barren oblast to forget who you are and what you are about if you are lucky.

However, in the Western socialist democracies, it is a combination in the belief of equality of outcome and that the population can be controlled more or less by the state acting as controller by the provisions it makes that have eroded personal responsibility in many nations.

Post SHTF, to have any kind of prison system, you would need the resources for it and I cannot see those resources being available, not even for a trial. Any kind of justice system and code of laws would need a lot more than a small group to make it work. Several hundred to a couple of thousand at least I think.
